<p>Yep, once again, more red tape to comply with I&#8217;m afraid.</p>
<h1><span style="font-size: large;">The New Legal Rules</span></h1>
<p>The new rules were first announced in September 2010, to give people six months to change the way they market online. And the deadline for complying with the updated rules was 1st March 2011.</p>
<p>Unfortunately, a lot of people just don’t know about these new rules and are putting themselves at risk of an investigation by the Advertising Standards Authority (ASA).</p>
<h2><span style="font-size: large;">How To Get Legal</span></h2>
<p>I’ve found a great guide which simplifies the new guidelines (the originals are over 100 pages long!).</p>
<p>It&#8217;s called; The CAP Code Guide.</p>
<p>The CAP Code Guide contains tools, checklists and summaries of key facts to make it really easy for you to audit your own online business communications.</p>
<p>It&#8217;s a quick and easy way to comply with the new rules.</p>

<p class="dtm-content">The Marketing Mix is one element that makes up your marketing strategy.</p>
<p class="dtm-content">This includes:</p>
<ul>
<li><strong>Price</strong></li>
<li><strong> Product</strong></li>
<li><strong> Place</strong></li>
<li><strong> Promotion</strong></li>
</ul>
<p class="dtm-content">They&#8217;re also known as the 4 “P’s.” It&#8217;s important for an organization to have a good understanding of these factors. They&#8217;re important when developing a marketing plan.</p>
<ul>
<li><strong>Price</strong>: What&#8217;s the highest amount the customer will pay for the product or service? Many times setting the incorrect price level is the beginning of a lot of problems for an organization. An organization must be sure their price is not too high or too low. Mistakes either way will hurt the organization’s income. When an organization is starting up, it&#8217;s important they focus their price levels on at least breaking-even. A break-even analysis is necessary to determine the price to set to avoid a loss.</li>
</ul>
<p class="dtm-content">&nbsp;</p>
<ul>
<li><strong>Product</strong>: What you are trying to sell to the customer. An organization needs to have an in depth understanding about what it is they are marketing. Development of the product’s size, quality, design, brand name, packaging are important when trying to match with customer’s needs and wants. An organization should explain how their product’s features benefit the customer.</li>
</ul>
<p class="dtm-content">&nbsp;</p>
<ul>
<li><strong>Place</strong>: This is where the customer comes into contact with the product. An organization needs to make sure the product or service they&#8217;re offering is in the appropriate location where its target market can reach it. An obvious example of poor placement is developing a ski resort in a desert! It&#8217;s also important to look at the logistics necessary to reach its customers and any geographical barriers that might exist. A B&amp;B will not get many visitors if they have to travel on a poorly lit, gravel road.</li>
</ul>
<p class="dtm-content">&nbsp;</p>
<ul>
<li><strong>Promotion</strong>: The method of marketing to the customer so they gain knowledge about the product and be persuaded to purchase it. There are many different types of promotional activities that can be used.</li>
</ul>
<p class="dtm-content">However, a recent trend focuses the marketing mix directly on the customer. Instead of the 4 “Ps”, there is the 4 “Cs.”</p>
<ul>
<li><strong>Customer value</strong>: how much the customer values the product.</li>
</ul>
<p>&nbsp;</p>
<ul>
<li><strong>Cost to the customer</strong>: also includes customer’s time and energy, along with price of the product.</li>
</ul>
<p>&nbsp;</p>
<ul>
<li><strong>Convenience for the buyer</strong>: similar to place.</li>
</ul>
<p>&nbsp;</p>
<ul>
<li><strong>Communication</strong>: similar to promotion.</li>
</ul>
<p>The plain truth is many organizations offering services struggle when trying to apply the 4 “P’s” concept to their marketing plan. They&#8217;re missing one of the “P’s,” &#8211; product. Services are intangible, produced and consumed at the same time, relying heavily on the organization’s personnel and the performance of staff.</p>
<p>Marketing services require a complete dedication to understanding the customer. All staff in the organization must have a complete understanding of the customer and their relationship with the customer. The critical thing here is relationship marketing is the most important concept for service-based organizations.</p>

<p>Marketing is an art. Good marketing understands different cultures and adapts to people&#8217;s needs and desires. It&#8217;s much easier to customise a marketing plan for a foreign market, than it is to try to change others&#8217; cultures to sell and promote your products.</p>
<p>Here&#8217;s a simple example:<br />
Mc Donalds. It has a customised marketing plan to adapt to other countries in foreign franchises. For instance, in the middle east, they offer rice with meals. Or in the States or Canada, they offer some hispanic meals in hispanic areas.</p>
<p>This thinking keeps the door open for improvement and ensures success. Products can be developed to look more attractive to the target markets and gains their loyalty.</p>

<p>The whole idea is to do one task at a time during day and stop multitasking for once in your life.</p>
<p>See the thing is, according to experts, multitasking could well be bad for you.</p>
<p>In fact, studies from University of Michigan and UCLA indicate Multi-tasking forces our brains to continually perform “Task Switching” which makes our brains work harder with less efficiency.  Some researchers believe this could even cause brain damage! So sorry ladies, but us guys had it right all along!</p>
<p>Now  Single-Tasking Day is meant to help us focus on one activity at a time and NOT do anything else until its complete. A tall order in this day and age, but with anything like this, you have to be ruthless to see it through.</p>

<p>Now as a copywriter, I picked up a great tip to help with this very thing. It came from copywriting legend Gene Schwartz.</p>
<p>He used to advise young copywriters to prevent distractions by using a kitchen timer.</p>
<p>He&#8217;d set the timer to 33 minutes and work solidly on the copy he was writing until the bell rang. Then he&#8217;d take a 5 minute break doing something completely different to rest his brain, then set the timer to 33 minutes again and so on.</p>
<p>I use this technique a lot and it works fine for me.</p>
<p>So give it a go and find a time setting that works for you. That way, everyday will be Single-Tasking Day and you won&#8217;t have to think about it.</p>

And that&#8217;s only natural. So there will be times when you need to give yourself a confidence boost by talking positively to yourself on the inside.</p>
<p>But here&#8217;s where you can get a jump on other people, because the majority of people are more likely to self talk to themselves negatively rather than positively &#8211; this is what holds them back in life.</p>
<p>It&#8217;s about the right attitude &#8211; the quality of your thinking.</p>

<p>There were the usual sounds of people talking and chatting as they went about their business.</p>
<p>But then, over the noise, I heard the call of a Big Issue seller&#8230;</p>
<p>The Big Issue is a charity that publishes a weekly entertainment and current affairs magazine, sold by homeless and vulnerably housed people to earn a legitimate income. It gives them a chance of earning some money and helping them along.</p>
<p>They can be seen selling the magazines in many UK High Streets all year round.</p>
<p>Now what caught my attention about this particular seller, was what he was saying&#8230;</p>
<p>&#8220;Get your Big Issue here. Can be read from cover to cover in 20 minutes, a guaranteed cure for insomnia and you get two free staples with every issue.&#8221;</p>
<p>Brilliant!</p>
<p>I thought it was a very clever piece of marketing.</p>
